The information was filed with the Registrar on race day and was served on Mr Court at the meeting of Banks Peninsula Trotting Club at Motukarara Raceway on Sunday, 13 April 2008. Mr Court had signed the Statement by the Defendant on the information form indicating that he admitted the breach and, further, that he did not wish to be present at the hearing of the information. The charge was found proved accordingly.

Mr McIntyre informed the Committee that Mr P J Davis was notified to the Stipendiary Stewards as the driver of LIFE GOES ON, by Mr Davis and the owner of the horse, at approximately 12.30pm on race day. Mr Court was not present at that meeting and had explained to the Stewards that he simply forgot to advise a driver for the horse.

Mr Court was fined the sum of $50.
