| -- RACE No.3: --An information lodged by Stipendiary Steward, Mr J Muirhead, against Mr T Milina, driver of STRAPLESS alleging a breach of rule 869(3)(b) in that he drove his horse carelessly causing interference to ILLIN, driven by Mr L Chin, with approximately 2000m to run. Mr Milina admitted the breach and was present at the hearing. Mr Muirhead demonstrated the incident on the video film. Mr Milina improved his horse from the three wide position to one out in a gradual manner but in doing so his sulky wheel struck the near foreleg of ILLIN causing the horse to break and lose considerable ground. ILLIN recovered and finished 4th and therefore the interference probably cost it a chance of winning the race. Mr Milina said he did not think the incident was really bad and that some outward movement by ILLIN contributed. ----Penalty: ----Mr Muirhead said Mr Milina was fined $250 for driving in a manner likely to cause interference on 2/09/04 and that on 10/09/04 he was warned about poor tactical driving and advised to improve the standard of his driving, this warning and advice relating to a separate incident on the 2/09/04. Mr Muirhead said Mr Milina had only had 8 drives this season and 17 drives last season. He suggested suspension of Mr Milina's horseman's licence for a period of one month. Mr Milina said he did not think his driving was really bad and he would leave penalty to the committee. In imposing penalty the committee took into account the following matters ? ----
-- -- -- -- -- Having taken all of those matters into account the committee decided to suspend Mr Milina's horseman's licence until the conclusion of racing on the 4th March 2005, effectively six weeks. |
