The Information alleges that the rider of FASLIYITSA allowed his mount to shift in and severely check SENORITA IVORY (L Rutherford) near the 900 metre mark.
----TJ Russell was the rider of FASLIYITSA. He admitted the breach and was present at the hearing. The rule was read and Mr Russell acknowledged he understood it.
----Films of the alleged incident were then shown and interpreted by Mr McCutcheon. Mr Russell had no questions of Mr McCutcheon or his interpretation of the films.
----For his part Mr Russell said, his horse jumped slow, there was no pace on, so he decided to go to the front, he went round the field and when moving in did not see Miss Rutherford.
----Mr McCutcheon said it was a sharp inward movement made by Mr Russell when not sufficiently clear, and had Miss Rutherford not been an experienced rider able to quickly check her mount, there could have been serious consequences.
----Both parties confirmed they had nothing further to add and left the judicial room.
----Mr McCutcheon then returned to the room with Mr Russell to inform the judicial committee that the race was a Listed race.
----The Committee took into account all of the evidence both verbal and the films shown to them and the fact Mr Russell had admitted the breach prior to arriving at a penalty, also the fact that Mr Russell had not been charged under this rule since the 26/12/03. He had however had six weeks off riding in that time.
----They considered the breach to be not of a minor nature and one that must have a penalty that reflects that.
----Mr Russell may ride at Te Rapa on the 8 September 2004, and is then suspended until midnight on the 18 September 2004, in effect five days, one of which is a Premier day.
