Decision:
Following the running of Race 9, RRT- Murray Butt Memorial Handicap Trot, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Junior Driver, Mr S P Walkinshaw, alleging a breach of Rule 869 (3) (b) in that, as the driver of GLENBOGLE in the Race, he “drove carelessly when striking the wheel of DEL’S HOOF N IT”.
DECISION AND REASONS:
--Following the running of Race 9, RRT- Murray Butt Memorial Handicap Trot, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Junior Driver, Mr S P Walkinshaw, alleging a breach of Rule 869 (3) (b) in that, as the driver of GLENBOGLE in the Race, he “drove carelessly when striking the wheel of DEL’S HOOF N IT”.

Mr Walkinshaw had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.

Rule 869 (3) (b) provides as follows:
--(3) No horseman shall in any race drive:
--(b) carelessly

Mrs K R Williams showed video replays of the relevant part of the Race, with approximately 300-350 metres to race. She pointed out GLENBOGLE racing 3-out and one back trailing DEL’S HOOF N IT. She pointed out the horse getting onto and striking the wheel of DEL’S HOOF N IT, breaking and going back onto KING CHARLIE (N R McGrath). Mrs Williams informed the Committee that Mr Walkinshaw had no recent breaches of the Rule on his record. Mrs Williams recommended a fine of $200.

The Committee, in determining penalty, had regard to Mr Walkinshaw’s admission of the breach and his previous good record. He was fined the sum of $200.
