Following Race 2 protests were lodged by Stipendiary Steward, Mr A Coles. The information alleges that DAUNTLESS (No.5) placed 2nd by the judge, interfered with the chances of INDIKATOR and ONMEPATMALONE placed 3rd/4th respectively by the judge.

--

Both protests were heard together.

--

The margins were 2 lengths between second and third and a long neck between 3rd and 4th.

--

All connections were notified of the protest hearing.

--

Present during the hearing were, representing DAUNTLESS ? trainer C Wood and rider, L Cropp.

--

Representing INDIKATOR, trainer K Opie, rider N Harris.

--

Representing ONMEPATMALONE, trainer S Pinfold, rider L Innes.

--

The two protests were heard together concurrently.

Mr Oatham demonstrated the video films (side-on and head-on). He showed at the 200-metre mark DAUNTLESS ridden by L Cropp move out and take the line of ONMEPATMALONE. This caused Mr Innes to check his mount off heels and change his ground to the inside. Shortly after this DAUNTLESS continued to move outwards into the line of INDIKATOR ridden by N Harris, which also received a sharp check.

Mr Harris said that coming to the last 100 metres he believed he had a good chance but received a sharp check from DAUNTLESS and as a result lost considerable momentum. Mr Opie, trainer, adopted Mr Harris' evidence.

Mr Innes rider of ONMEPATMALONE, said that he was checked by DAUNTLESS who moved out into his line, which caused him to stop riding. He believed that the interference cost him more than two lengths. Mr Pinfold, trainer of ONMEPATMALONE agreed with Mr Innes' evidence, but added that the interference cost him third placing.

Mr A Coles said that the films confirm that both horses were held up and had their momentum stopped. He said INDIKATOR was improving at the time of the interference. He submitted that the margins be considered carefully.

Mr C Wood said his horse did not roll out but Mr Harris only stopped riding for two strides. He said that the first two horses pulled away and there was a two-length margin at the winning post.

After considering all the evidence the committee is satisfied that DAUNTLESS caused interference to INDIKATOR and ONMEPATMALONE at the 200-metre mark. The committee was further satisfied that the chances of INDIKATOR and ONMEPATMALONE finishing in a better place were affected. In applying their discretion in respect of the protest by ONMEPATMALONE, the committee was satisfied that the interference he suffered cost him approximately two lengths and the margin between 4th and 3rd was a long neck. Accordingly the protest is upheld.

In respect of the protest by the 3rd horse INDIKATOR against the second horse DAUNTLESS, the committee in exercising their discretion are also satisfied that the interference of DAUNTLESS moving out in to the line of INDIKATOR caused Mr Harris to check off heels and losing momentum at a critical stage of the race.

The committee took into account the strong finish of INDIKATOR after losing considerable amount of ground, and took into account the margin between 2nd and 3rd. Accordingly the protest is upheld.
