Mr Escott, Chief stipendiary steward, alleged that at the New Zealand Metro Trotting Club Meeting on 7 October Mr C De Filippi in race 6 failed to report to a stipendiary steward that the pull down blinds on ALTA SIROCCO had failed to activate. He provided a signed approval from Mr Rennell, General Manager HRNZ, granting permission for an information under rule 864(3) to be filed by Mr Escott pursuant to rules 1103(4)(c) and 216 (stipendiary stewards' reviewing powers).

Mr De Filippi, your obligations under the Rules of Harness Racing are clear. If there is a gear malfunction, you must report it to a stipendiary steward forthwith. This, as you have accepted, you did not do. We take into account that it was premier meeting, and that the race had a stake of $30,000. We accept your statement that your omission was not deliberate. It was a busy night for all concerned, and you simply overlooked the matter.

In these circumstances we believe that the matter can be dealt with by way of a fine at the lower end of the range suggested by Mr Escott. We fine you the sum of $200. We acknowledge your observation as to the fact that the performance of the horse was unlikely to be improved had the gear in fact worked and that you made every endeavour to activate the gear, but these factors do not alter the fact that your subsequent actions were in breach of rule 864(3). We take this opportunity to remind you, as a senior horseman, of the need to fulfil your obligations under the Rules of Harness Racing, even though it be a busy night.
