Following Race 5 an information was filed pursuant to Rule 871(1)(d). Stipendiary Steward Mr J Oatham alleged that Mr C Grylls, rider of SMELL THE COFFEE, angled his mount out near the 300 metres when not sufficiently clear of MORELLE (M Coleman) who was badly hampered.

Following Race 5 an information was filed pursuant to Rule 871(1)(d). Stipendiary Steward Mr J Oatham alleged that Mr C Grylls, rider of SMELL THE COFFEE, angled his mount out near the 300 metres when not sufficiently clear of MORELLE (M Coleman) who was badly hampered.

Mr Grylls admitted the charge and was represented by trainer Mr P Moroney.

Stipendiary Steward Mr M Williamson demonstrated the video films which clearly showed Mr Grylls angle his mount out and into the line of MORELLE when only 3/4 length clear of that runner.

Mr Moroney said that Mr Grylls was racing in tight quarters and in taking evasive action failed to look to his outside when only 3/4 lengths clear,

PENALTY SUBMISSIONS:

Mr Oatham produced Mr Gryll's record which showed only 1 suspension in the last 12 months. He submitted a 4-6 day suspension was appropriate.

Mr Moroney said on Mr Gryll's behalf there was some mitigation in his favour.

The committee considered all submissions and before imposing penalty took into account:

  1. Mr Grylls' excellent record. --
  2. Mr Grylls' guilty plea. --
  3. Level of carelessness and degree of interference suffered by MORELLE.
--

Accordingly, we suspend Mr Grylls from after racing on January 2nd 2009 until after racing on January 7th 2009. (5 days) This follows Mr Grylls submitting he had engagements until 2nd January and was riding at Reefton on January 7th.
