Following Race 2 an Information was filed by the Informant, John Oatham, pursuant to Rule 871(1) (d).  He alleged that Mr J McDonald, rider of Alexa angled his mount outwards to obtain clear running forcing Waitoki Lad (T Harris) to check and shift outwards to avoid the heels of Alexa.



Following Race 2 an Information was filed by the Informant, John Oatham, pursuant to Rule 871(1) (d).  He alleged that Mr J McDonald, rider of Alexa angled his mount outwards to obtain clear running forcing Waitoki Lad (T Harris) to check and shift outwards to avoid the heels of Alexa.

Mr McDonald pleaded guilty and was represented by his employer Mr B McDonald.

Mr Coles demonstrated the video films and showed where, soon after entering the home straight Mr J McDonald riding Alexa and having no run directly ahead, angle his mount out and into the line of Waitoki Lad (T Harris) without being sufficiently clear.  Mr Coles said there was no contact but there would have been if Mr Harris had not taken evasive action.

Mr. Oatham said Mr McDonald had 4 charges in the last 12 months.  He believed this offence was in the mid range and warranted 4 days

Mr B McDonald had nothing further to add other than to say Mr McDonald had no firm commitments after today’s racing.

The Committee considered all submissions and before imposing a fair penalty took into account the following:

Accordingly we impose a suspension to start after racing today, 30 January 2009 and finish after racing on 6 February 2009 (4 days)
