Following Race 10 an Information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr AR Coles, that Mr R Norvall rider of GALLIONS REACH committed a breach of that rule

DECISION AND REASONS:

Following Race 10 an Information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr AR Coles, that Mr R Norvall rider of GALLIONS REACH committed a breach of that rule when he angled his mount outwards when not sufficiently clear, making contact with STABINTHEDARK (C Tremayne) on several occasions.

This information was filed following the hearing of a protest involving the same incident when Mr Coles had reserved the right to lay further charges. In excercsing his right Mr Coles sought agreement that the previous evidence from the protest hearing be taken as read. This was accepted by all parties.

Mr Norvall admitted the breach.

In making submissions on penalty, Mr Coles said that Mr Norvall was an experienced rider with a very good record, having been suspended only once in the previous 12 months. He also said that Mr Norvall had a confirmed ride in the Wellington Cup. He did say, however, that a suspension was warranted.

Mr Norvall said that he was trying to do the best for the punters who had made his mount race favourite.

Accordingly, the committee suspended him from riding, commencing after the conclusion of racing on the 25 January 2006 until the conclusion of racing on the 29 January 2006 (3 days).
