Charge:
Following the running of Race 5 Information A5178 was filed by Stipendiary Steward Mr S Renault alleging a breach of Rule 869 (2)(a) by Open Horseman M Edmonds. The Information stated that “You (M Edmonds) used your whip in an excessive manner over the concluding stages of the race.”
Rule 869 (2)(a) states:- “No horseman shall during any race…..use his whip in an unnecessary, excessive or improper manner”;
Mr Edmonds confirmed he admitted the breach of the Rule and also that he did not wish to be present at the hearing.
Facts:
Mr Renault used the films to highlight Mr Edmonds travelling in the “one one” position turning for home. He said from the top of the straight Mr Edmonds has used his whip 24 times with some of the strikes being on the sulky shafts or dust sheet. He said none of the strikes were severe and as a result the Stewards considered the breach to be at the low end of the scale. However, Mr Edmonds was a very experienced driver with over 4600 life time drives including 193 last season and 124 so far this season who was well aware of the “Use of Whip Guidelines” and 24 strikes in the home straight was too many.
Submissions on Penalty:
Mr Renault said Mr Edmonds had not breached this Rule in the previous 12 months, had cooperated fully with the Stewards and he submitted a fine of $200 was an appropriate penalty.
Reasons:
As Mr Edmonds has admitted the breach the committee finds the charge proved in accordance with Rule 1111 (1) (d). After considering the films of the incident the Committee believes the severity of the breach is at the low end. We have also noted Mr Edmonds has not breached this Rule in the previous 12 months and after reviewing the list of penalties given in the past 15 months for breaches of this Rule the Committee believes a fine is an appropriate penalty on this occasion.
Penalty:
The Committee imposes a fine of $200.
