Decision:
Following the running of Race 7, Sydenham Bakery Limited Mobile Trot, at the meeting of New Zealand Metropolitan Trotting Club at Addington Raceway on 10 September 2009, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Open Horseman, Mr P C Nairn, alleging a breach of Rule 869 (2) (a) in that Mr Nairn “whilst driving STELLAR SPORT used his whip excessively throughout the final stages”.

Following the running of Race 7, Sydenham Bakery Limited Mobile Trot, at the meeting of New Zealand Metropolitan Trotting Club at Addington Raceway on 10 September 2009, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Open Horseman, Mr P C Nairn, alleging a breach of Rule 869 (2) (a) in that Mr Nairn “whilst driving STELLAR SPORT used his whip excessively throughout the final stages”.
--The information was filed with the Registrar on raceday and was served on Mr Nairn at a trials meeting at Methven on Saturday, 12 September 2009. The charge was heard at the meeting of New Zealand Metropolitan Trotting Club at Addington Raceway on 18 September 2009.
--Mr Nairn had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.
--Rule 869 provides as follows:
(2) No horseman shall during any race:-
(a) use his whip in an unnecessary, excessive or improper manner.
Mr Ydgren showed a video replay of the final 300-400 metres of the Race and pointed out Mr Nairn, wide on the track, turning into the home straight. Shortly thereafter, he turned his whip around and used it approximately 21 times, with no pause whatsoever, until the horse broke short of the finishing line.
--Mr Ydgren informed the Committee that Mr Nairn had a clear record over the past 12 months. He sought a fine of $200.
--In determining penalty, the Committee had regard to Mr Nairn’s admission of the breach and his previous good record.
--Mr Nairn was fined the sum of $200.
