After the running of Race 4 at Hastings, The Agricom Maiden Steeples, a protest was lodged by J Rathbone, the rider of ASSET STRIPPER, provisionally placed 2nd by the judge, alleging interference over the final 100 metres by BRUSHMAN ( R Eynon) provisionally placed 1st by the judge.

After the running of Race 4 at Hastings, The Agricom Maiden Steeples, a protest was lodged by J Rathbone, the rider of ASSET STRIPPER, provisionally placed 2nd by the judge, alleging interference over the final 100 metres by BRUSHMAN ( R Eynon) provisionally placed 1st by the judge.

Both trainers informed the committee that connections of either horse were not present.

J Rathbone ( jockey) using both films available informed the committee that after completing the last fence BRUSHMAN took ASSET STRIPPER’S line in the run to the finish. She told the committee she felt that her chances of winning were severely affected by the pressure her mount was placed under by the inward movement of BRUSHMAN. The margin at the finish was only a neck. She said her horse could not be completely ridden out because of the movement and if she had a straight run in she would have finished in 1st place.

Mr M Oulaghan had no questions of Miss Rathbone’s interpretations of the films.

Mr K Myers had no comment.

Mr M Oulaghan revisited the available films and informed the committee that he felt after jumping the last fence contact was made by ASSET STRIPPER on his horse.

In answer to a question Mr Oulaghan agreed that the protest did concern the last 100 metres.

He also conceded that although he felt ASSET STRIPPER did over react his horse BRUSHMAN did take its line in the run to the finish

Mr R Eynon had no comment.

Stipendiary steward Mr A Coles, under the Rules of racing was asked to comment.

He told the committee that the films proved that ASSET STRIPPER’S line was taken, contact does not have to be made for interference to occur, and the horse’s chances of finishing in a higher placing was definitely affected by BRUSHMAN’S actions. He asked for placings to be changed.

DECISION AND REASON

--

In coming to our decision to change placings we have taken notice of the margin between the horses at the finish ( neck). The films clearly showed that upon completing the final fence and straightening BRUSHMAN began a substantial inward movement, especially over the last 100 metres. We are of the opinion that ASSET STRIPPER’S line was taken and that contact does not have to be made for interference to occur.

The committee is strongly of the opinion that ASSET STRIPPER‘S chances were badly affected and placings should be changed.

The placings now read 1--2--6--4--3--5
