Following the running of Race 2 the siren sounded instigating a protest.
--It was alleged that the horse provisionally placed 1st by the judge, Glamazon with about 270 meters to run interfered with horses on its outside and caused tightening to those horses, affecting their chances of finishing in a higher placing.

Following the running of Race 2 the siren sounded instigating a protest.
--It was alleged that the horse provisionally placed 1st by the judge, Glamazon with about 270 meters to run interfered with horses on its outside and caused tightening to those horses, affecting their chances of finishing in a higher placing.
--Siren sounded at 12.45 – Hearing commenced at 12.58.
--Stipendiary Steward K Williams read Rule 869 (8) and Mrs Neal confirmed her understanding of the rule.
--Stipendiary Steward Taumanu informed the committee that with approximately 210 metres to run J Dickie, driver of Glamazon, moved inwards over the pylons then angled his mount outwards causing tightening to Ohau Dynamic – Pockets on Fire – County Down and BJs Falcon – forcing Mr Doody, driver of BJs Falcon, to take hold of his drive, putting him under severe pressure. The available films, head-side and back were shown.
--Mr Doody confirmed under questioning that he did have to take hold and he was placed under pressure.
--Mrs Neal had no questions.
--Mr Abernathy, driver of unplaced Mister Efcebee, told the committee that he was entitled to be where he was and that he was pushed outwards by Mr Doody’s horse as it came across. He did inform Mrs Neal under questioning that he wasn’t travelling all that well and that the pressure came from his inside.
--Mrs Neal confirmed that contact was made but Glamazon did win easily and that Mr Doody’s drive was only battling. Mr J Dickie told the committee that he attempted to go for the inside run, couldn’t get through, then angled outwards taking pylons in his movements. He felt he was clear when he angled across and that he did attempt to straighten.
--In summing up Mr Taumanu felt the films were conclusive, they showed the check to the effected horses by the angled movement of Glamazon.
--He confirmed the margins in the provisional placing of ¾ - ¾ - 1½ - 4½ and conceded that BJs Falcon may not have won the race but then again no one could be sure and that the interference he suffered eliminated any chance.
--Mrs Neal in summing up felt her horse was always going to win – it had enough room and the incident was unfortunate.
--Mr Yardley (owner) concurred with Mrs Neal that he felt his horse was always going to win and was travelling the best.
--Decision and Reason:
Rule 869 (8) (b) read – “may have interfered with, or whose horse may have interfered with, the progress or chance of any other horse, or horses”.
The films side-head and rear showed conclusively the movement initially inward over the pylons by Mr Dickie’s drive, then the angled movement outwards causing severe tightening to Mr Doody’s drive and slight tightening to the other effected horses.
--We did consider carefully Mrs Neal’s submissions that hers was the best horse (the margins proved that) and it was always going to win.
--However the severe tightening to Mr Doody’s drive was of a degree that eliminated any change of his drive from finishing in a higher placing.
--The protest was upheld and the placings now read ...
