Following the running of Race 3, the Classic Hits Marlborough Mobile Pace, an information was filed by Stipendiary Steward Mr S. P. Renault against Mr C. T. Woodward (Jnr), the driver of SUNSET DREAM (9), alleging that he had committed a breach of Rule 869(2)(a) in that he used his whip excessively.

Following the running of Race 3, the Classic Hits Marlborough Mobile Pace, an information was filed by Stipendiary Steward Mr S. P. Renault against Mr C. T. Woodward (Jnr), the driver of SUNSET DREAM (9), alleging that he had committed a breach of Rule 869(2)(a) in that he used his whip excessively.
--Mr Woodward had indicated on the information that he admitted this breach of the Rules and he confirmed this at the hearing. Mr Woodward also agreed that he understood the charge, the Rule it was brought under, and the “Use of the Whip” guidelines.
--Mr Renault gave evidence and used video coverage to show that Mr Woodward had taken the lead soon after entering the home straight, and that he had used his whip on about 23 occasions in the run home.
--Mr Woodward did not dispute the evidence of the Stipendiary Stewards.
--Penalty:
--In relation to penalty Mr Renault advised that Mr Woodward had a previous conviction on 30 December 2008 at Reefton when he was suspended for two days, and recommended a fine of $300-00 or a three day suspension. Mr Woodward was at this stage asked if he preferred a suspension to fine, and he said he preferred a fine.
--We adjourned to consider the matter of penalty. We took into account that Mr Woodward had admitted this breach, and also his previous conviction. Taking these matters into account we were satisfied that a fine of $300-00 was appropriate in this case.
--On resuming the hearing we advised the parties that Mr Woodward was fined the sum of $300-00.
