Following the running of Race 4, the Crowne Plaza Christchurch Mobile Pace, an information was laid by Mr N. R. Escott, Chief Stipendiary Steward, against Mr S. Walkinshaw (Junior Horseman) driver of Guru (10), alleging a breach of Rule 869(3)(b).

DECISION AND REASONS:

--

Following the running of Race 4, the Crowne Plaza Christchurch Mobile Pace, an information was laid by Mr N. R. Escott, Chief Stipendiary Steward, against Mr S. Walkinshaw (Junior Horseman) driver of Guru (10), alleging a breach of Rule 869(3)(b). The charge was that Mr Walkinshaw drove carelessly in the final straight, striking A. F. H. Hunter's sulky and causing his own horse to break.

Mr Walkinshaw had indicated on the information that he admitted this breach and he confirmed that at the hearing. He was assisted at this hearing by Mr C. Markham an Open Horseman.

Stipendiary Steward Mrs Williams used video coverage of the race to illustrate this incident, and it could be seen that Mr Walkinshaw had allowed his horse to make contact with Mr Hunter's sulky.

In relation to penalty Mr Escott advised that Mr Walkinshaw was starting out on his career and had had 17 drives to date. He had a clear driving record and a fine of $200-00 was recommended. Mr Walkinshaw and Mr Markham had no submissions to make on penalty.

I was satisfied that a $200-00 fine was an appropriate fine in this case and Mr Walkinshaw was therefore fined the sum of $200-00.
