Following Race 1 an Information was filed by the Informant, John Oatham, pursuant to Rule 871(1) (D). He alleged that near the 300 metres Regal Ruler ( R Norvall) angled out causing interference to Lenny ( T. Thornton), Alexandrite (N Collett) and The Flaneur (S Spratt).

Mr Norvall pleaded guilty.

Mr Williamson demonstrated the video films and pointed out to the Committee Mr Norvall riding Regal Ruler angling his mount out at the 300 metre mark for a run on his outside. In doing so he moved into the line of Lenny (T. Thornton) when not the required distance clear being barely a length ahead. As a result Lenny was forced into the line of Alexandrite (N. Collett) and The Flaneur (S. Spratt) who both clipped heels and were lucky not to fall. Mr. Norvall said he angled his mount outside Diplomatic who kept moving out dictating his line accentuating his own outward movement.

PENALTY SUBMISSIONS

Mr. Oatham said Mr Norvall had an excellent record with only 1 breach in the last 12 months. However he submitted this was at the top end of carelessness and warranted a 2 – 3 week suspension.

Mr Norvall said he only had firm commitments for tomorrow 23/11/08.

The Committee considered all submissions and before imposing a fair penalty took into account the following:

- His guilty plea --
- Level of interference and the severe checks received by 2 horses who could have easily fallen. We concur with Mr Oatham that this is at the higher end of carelessness.

Accordingly we impose a suspension to start after racing on the 23/11/08 and conclude after racing on the 7/12/08, (10 days including Cromwell on 30/11/08 and Dunedin on 5/12/08).
