--Following Race 1 an Information was filed pursuant to rule 638 (1) (D). The Informant, Mr George alleged that Mr J Waddell, rider of CHOCOLATER, permitted his mount to shift inwards near the 1200 metres when not sufficiently clear of SETON BAY (M Hills). This caused SETON BAY to check with resultant crowding to RAINMAKER (A Peard) and GINGA LINI (Miss D Johnson).

--Following Race 1 an Information was filed pursuant to rule 638 (1) (D). The Informant, Mr George alleged that Mr J Waddell, rider of CHOCOLATER, permitted his mount to shift inwards near the 1200 metres when not sufficiently clear of SETON BAY (M Hills). This caused SETON BAY to check with resultant crowding to RAINMAKER (A Peard) and GINGA LINI (Miss D Johnson).
--Mr Waddell did not admit the breach.
--Mr Oatham demonstrated the video films and showed the Committee that, at a point approaching the 1200 metres Mr Waddell allow his mount CHOCOLATER to move in from a four wide position to one of three wide. It was clear to the Committee that Mr Waddell was a bare length clear of Mr Hills on his inside. This movement caused severe crowding to RAINMAKER and GINGA LINI resulting in GINGA LINI stumbling.
--Mr Waddell said he believed he was 2 lengths clear of Mr Hills when he moved in and in his opinion Mr Hills’ mount moved up on to his heels when the pace slackened.
--Mr George said the interference was not pace related and Mr Waddell had clearly moved in when insufficiently clear.
--DECISION
--The Committee carefully considered all evidence and reviewed the video film. We are clearly satisfied that Mr Waddell moved in when a bare length clear of Mr Hills on his inside. We do not accept Mr Waddell’s statement that the interference was caused by the slackening pace. Accordingly we find the charge proven.
--PENALTY SUBMISSIONS
--Mr George said Mr Waddell had a good record with one charge in the last 12 months. He submitted a suspension of 5 – 6 days would be appropriate.
--Mr Waddell reminded the Committee of his good record and that he had commitments until 13 March 2010. When asked, he said the only time he rode in the South Island was at Carnival times.
--PENALTY DECISION
--The Committee considered all submissions before imposing an appropriate penalty. The only mitigating factor in this charge is Mr Waddell’s good riding record. Against this is his level of carelessness which the Committee considers to be mid-range. In this case Mr Waddell showed little regard for the safety of riders in his inside.
--Taking all the above factors into account we impose a suspension on Mr Waddell from riding in races which is to start after racing on 13 March 2010 and conclude after racing on 24 march 2010 (5 days).
