Following the running of Race 3, the Sunny Brae Equine Services Maiden, Stipendiary Steward Mr S. C. Ching laid an information pursuant to Rule 871(1)(d) alleging Jockey Miss A. J. Chesmar, the rider of "Benoni" (12), rode carelessly.

DECISION AND REASONS:

--

Following the running of Race 3, the Sunny Brae Equine Services Maiden, Stipendiary Steward Mr S. C. Ching laid an information pursuant to Rule 871(1)(d) alleging Jockey Miss A. J. Chesmar, the rider of "Benoni" (12), rode carelessly. Miss Chesmar admitted this breach.

Mr Ching showed video coverage of the incident, which he described as being in the "mid range" of seriousness. The incident occurred at about the 200 metre mark when Miss Chesmar was riding her horse with the whip, and pushed "Mohaka" (11) ridden by J. Bullard onto the heels of "My Blue Print" ridden by T. Moseley.

Miss Chesmar had nothing to say about this matter, and accepted the evidence of Mr Ching.

Penalty: In relation to penalty Mr Ching advised that Miss Chesmar had an exemplary riding record with no convictions in the last 12 months. Mr Ching also said that the breach of the Rule was in the "mid range" and that the guilty plea should also be taken into account.

We adjourned to consider the matter of penalty. We took into account the following matters ?

Whereas a 3 day suspension would have been appropriate for this breach this was reduced to 2 days to take into account the above matters. The term of suspension is from the completion of racing on 25 February 2007 to the completion of racing on 8 March 2007.
