Following the running of race 7 the Stipendiary Stewards lodged an information against Mr D J Butt under Rule 869 (3) (b) alleging that he drove carelessly when allowing his horse Sunny Stone to strike the sulky wheel of Awesome Imace causing his horse to gallop.

DECISION & REASON
--Following the running of race 7 the Stipendiary Stewards lodged an information against Mr D J Butt under Rule 869 (3) (b) alleging that he drove carelessly when allowing his horse Sunny Stone to strike the sulky wheel of Awesome Imace causing his horse to gallop.
----At the outset of the hearing Mr Butt confirmed his written advice that he admitted the breach but did want to be heard at the hearing.
----Mr N Ydgren demonstrated the incident with the assistance of the video evidence. He asked the Committee to note that Sunny Stone was racing on the outside of Awesome Imace with Mr Butt taking hold of the horse and moving it into a trailing position. The video evidence then showed that Sunny Stone struck the wheel of Awesome Imace when racing fiercely causing that horse to break.
----Mr Escott said that Mr Butt was an experienced horseman and should have been aware of the risks associated with the manoeuvre he undertook which resulted in his horse breaking and losing all chance.
----Mr Butt, for his part, said that he was aware of his horse’s racing manners but attempted to get into the training position as he did believe it was not in the horses best interest to race parked over a fast mile. He accepted that he was guilty of allowing his horse to strike the sulky wheel of Awesome Imace.
----In respect of penalty Mr Escott advised the Committee that Mr Butt was an experienced driver, having driven in 6023 races with 797 wins. He had not appeared before a Judicial Committee under this rule in the preceding 12 months. He sought a monetary penalty only.
----Mr Butt said in respect of penalty that the incident was due to the racing manners of the horse and asked the Committee to take that into account.
--The Committee after giving consideration to the status of the race, the incident itself, the early guilty plea of Mr Butt and his frankness at the hearing, accepts that a monetary penalty only is appropriate and after giving consideration to the matters referred to above a fine of $150.00 is imposed.
