Following the running of Race 9, the Heiniger “Capex Classic” Handicap Trot, an information was filed by Stipendiary Steward Mrs K. R. Williams against Mr P. C. Nairn, the driver of “Kahdon” (9), alleging that he had committed a breach of Rule 869(2)(a) in that he used his whip excessively.

DECISION AND REASONS:

Following the running of Race 9, the Heiniger “Capex Classic” Handicap Trot, an information was filed by Stipendiary Steward Mrs K. R. Williams against Mr P. C. Nairn, the driver of “Kahdon” (9), alleging that he had committed a breach of Rule 869(2)(a) in that he used his whip excessively.

Mr Nairn had indicated on the information that he admitted this breach of the Rules and that he did not wish to attend the hearing.

--

Mrs Williams gave evidence and used video coverage to show that Mr Nairn had used his whip on about 20 occasions in the last 100 metres of the race, although most times he had hit the dust sheet.

--

In relation to penalty Mrs Williams advised that Mr Nairn has had two relevant previous convictions.  The first was on 18 September 2009 when he was fined $200-00 for a breach of this Rule which occurred at the NZMTC meeting on 10 September 2009.  The second conviction was on 4 March 2010 at the NZMTC meeting when he was suspended from after today’s meeting (7 March 2010), until after 14 March 2010, which was effectively a 4 day suspension.

On this occasion Mrs Williams recommended a 3 – 4 day suspension.

--

We were satisfied that Mr Nairn has a very poor record so far as this Rule is concerned, and that a suspension of his Open Horseman’s Licence is the only appropriate penalty.

--

Accordingly Mr Nairn’s Open Horseman’s Licence was suspended from after the completion of racing on 14 March 2010, until after the completion of racing on 23 March 2010, which is effectively a 4 day suspension.
