This was an information laid by Mr Knowles, stipendiary steward, alleging that Ms Davis, the trainer of SOUTHERN SUN had failed to attach the boring pole, causing it to come adrift approximately 80 metres from the finish. Ms Davis admitted the breach.

Mr Knowles explained it was new gear and it appeared not to have been done up properly. Ms Davis said it had been done up securely and it was not a gear failure. She demonstrated that the pole and strap were both brand new and it appeared the buckle on the strap had worked loose during the course of the race due to the strap being stiff and non-pliable. She said she realised now that she should have put tape over the buckle of the strap.

Mr Knowles said Ms Davis has been a trainer since the start of the season and had never previously been before the Committee on a matter relating to gear.

Mr Knowles said that a judicial warning, in his view, would suffice in the particular circumstances of this case. I accept Mr Knowles’ recommendation and find the breach proved but impose no penalty. However, Ms Davis is also reminded of her obligations under the Rules of Harness Racing.
