This matter was heard at the Canterbury Jockey Club’s meeting at the Riccarton Racecourse on 7 November 2009.

Following the running of Race 2, the D’Cash Dash, Stipendiary Steward, Mr M R Davidson, filed an information pursuant to Rule 616(2)(a) alleging Licensed Trainer Mr P D J Harris presented STELLAR BAY to race without blinkers when that gear had been notified to the National Racing Bureau.

This matter was heard at the Canterbury Jockey Club’s meeting at the Riccarton Racecourse on 7 November 2009.

Following the running of Race 2, the D’Cash Dash, Stipendiary Steward, Mr M R Davidson, filed an information pursuant to Rule 616(2)(a) alleging Licensed Trainer Mr P D J Harris presented STELLAR BAY to race without blinkers when that gear had been notified to the National Racing Bureau.

Mr Harris had indicated on the Information that he admitted this breach of the Rules, and that he did not wish to attend the hearing.

--

Mr Davidson gave evidence that Mr Harris had been questioned about this matter before the race, but disputed that his horse was to wear blinkers.  The matter could not be resolved and the horse actually ran in the race without blinkers.

It was later established that Mr Harris had in fact notified the National Racing Bureau that STELLAR BAY would be wearing blinkers, and a print-out of this notification was presented in evidence.

In relation to penalty Mr Davidson recommended a fine of between $175.00 and $225.00.

We were satisfied that the fine range recommended by Mr Davidson was appropriate in this case, and accordingly Mr Harris was find the sum of $200.00.
