Under Rule 871 (1) (d) Mr Ching, stipendiary steward, alleged that Ms C Anderson allowed her mount THORNLEA BAY to shift ground when not clear causing crowding to ALL SPICE (C Johnson) shortly after the start.

Under Rule 871 (1) (d) Mr Ching, stipendiary steward, alleged that Ms C Anderson allowed her mount THORNLEA BAY to shift ground when not clear causing crowding to ALL SPICE (C Johnson) shortly after the start.

Mr Ching had Mr Davidson, stipendiary steward, demonstrate the incident on the videos. This showed that there was an inwards movement from THORNLEA BAY immediately after the start which causing crowding to ALL SPICE, which had drawn the gate 2 inside THORNLEA BAY, for a several strides. We counted 5 strides. Mr Johnson had to check out as a consequence. The horse between THORNLEA BAY and ALL SPICE was not inconvenienced as it was slow away.

Ms Anderson admitted the breach and stated that there had been no call from Mr Johnson.

We agree with Mr Ching’s assessment of the breach as being mid range. He asked for a suspension of 4 to 6 days. We take a starting point of 6 days and give credit for Ms Anderson’s exemplary record and her ready admission of the breach. She indicated she had a confirmed ride on New Year’s day and wished any suspension to commence after this time. Mr Ching did not object. We suspend Ms Anderson from riding after racing on 1 January 2009 up to and including January 7. This is in effect 4 riding days.
