| -- DECISION AND REASONS: ----Following Race 4 an information was filed pursuant to rule 876(1) when it was alleged by the informant, Mr L Callaway, rider of the second horse TEXAS that SHAMROCK STAR, placed first by the judge interfered with the chances of TEXAS, placed 2nd by the judge. This interference is alleged to have occurred over the final stages of the event. The margins between 1st and 2nd at the post, was a nose. ----Mr Callaway demonstrated the video film and said he was three out and in the clear when Mr Calder's horse rolled out a bit. He said that he was interfered with and being only beaten by a nose, in his opinion it cost him the race. ----Mr M Fraser-Campin, trainer of TEXAS, said Mr Calder rolled out at both the 250 and 100 metre marks. He said TEXAS really lets down and Mr Callaway had to stop riding and could only ride hands and heels for the last 30-40 strides of the race. He said his horse was impeded and being only beaten by a nose, in his opinion, cost him the race. ----Mr Calder, rider of SHAMROCK STAR, used the side-on film to show that in his opinion, it was quite clear that Mr Callaway had not stopped riding. He said the movement was very minor and only for one stride. He said that TEXAS had also rolled in and the contact was very marginal ----Mr Oulaghan, trainer of SHAMROCK STAR agreed with Mr Calder and agreed that TEXAS had also moved inward. ----Mr McCutcheon, Chief Stipendiary Steward, said that the first movement outwards by SHAMROCK STAR did not cause any interference and the second movement caused a slight brush. He concluded by saying that TEXAS contributed to the incident. ----Decision: --The first question the committee must address is whether interference did occur. After listening carefully to all the evidence and viewing the video films several times, the committee is satisfied that minor interference did occur to TEXAS when SHAMROCK STAR momentarily rolled out towards TEXAS. ----However, when addressing the second question of whether that interference affected the chances of TEXAS finishing in a better place, the committee are satisfied that the nature of this interference did not affect his chances. ----The reasons for this are as follows ? --
-- -- -- Accordingly, the protest is dismissed and the judges placing shall stand. |
