An information was filed instigating a protest following the running of race 9 .

The informant was Mr T W Taumanu Stipendiary Steward and this was a protest by horse number 11 Nacokee, placed 10th by the judge against horse number 13 Summer Man placed 4th by The judge. The judges placings for this race were 1st No 10, 2nd No 3, 3rd No 7, 4th No 13, 5th No 8, 6th No 1.

Present at this hearing were Mr. P C Ferguson the driver of Summer Man , Mr. D K Gibbons the trainer of Summer Man who was representing the connections of this horse. Mr. Sharp the driver of Nacokee was also called to give evidence.

Mr. Taumanu alleged that Summer Man had caused interference to Nacokee when coming out quickly with 150 meters to run.

Mr. Taumanu showed the video of this incident and this showed at or about the 150 meter mark in the run home Mr. Ferguson angling Summer Man out to make his run and in doing so he came out very quickly and although contact was not made Mr. Sharp had to take hold of his horse Nacokee which in turn broke from its gait and continued in a gallop for some distance.

Mr. Sharp stated in his evidence that his horse was traveling well and he had to take hold of his horse because of the outward movement of Summer Man driven by Mr. Ferguson.

Mr. Taumanu acknowledged that no contact was made by Summer Man onto Nacokee.

Mr.Ferguson gave evidence and stated that his horse gave him a difficult drive and Mr. Ferguson blamed Mr. Sharp for anticipating what may have happened, Mr.Ferguson said Mr. Sharp took hold of his horse too soon and that in his opinion Nacokee had broken because of Mr. Sharp taking hold anticipating what may have happened.

Mr. Gibbons argued that Nacokee was trotting rough round the last turn and he also was of the opinion that Mr. Sharp had taken hold to quickly. Mr. Sharp acknowledged that his horse trotted rough around the last bend however he also stated his horse was trotting well when this incident happened

Mr. Taumanu summed up as did Mr.Ferguson.

Decision and Reasons.

This judicial committee finds that interference has taken place to Nacokee at or about the 150 meter mark in the run home. We find the breach of rule 869 (8 ) proven for the following reasons.

--

Summer Man came out very quickly as alleged by Mr. Taumanu, the video evidence of this incident is very clear. By coming out sharply as he did we find that Summer Man has taken the line of Nacokee and had Mr. Sharp not taken hold of his horse contact would have been made.

Mr. Feguson in his evidence said Summer Man gave him a difficult drive however Mr Ferguson did not elaborate on this. This judicial committee finds that it was the outward movement of Summer Man that caused Nacokee to break stride and gallop

The amended placing for this race shall be 1st No 10, 2nd No 3, 3rd No 7, 4th No 8, 5th no 1.
