Rule Reads:
--No horseman in any race shall drive carelessly.
--Decision and Reason:
--An information was lodged by Stipendiary Steward Mr P T Knowles alleging that Miss K L Green drove carelessly with approximately 100m to run when shifting ground inwards on EASTWOOD ALBATROSS causing COOL PUBLICAN to break.
--All information from the judicial protest (Information number 13255) was taken into consideration as agreed by Mr Knowles and Miss Green. A further opportunity was given to all parties to introduce any new evidence or to re-iterate any evidence that may have been not clearly outlined during the previous hearing.
--Mr Larkins (Stipendiary Steward) outlined the alleged breach by using several video clips of the incident. Mr Knowles re-questioned Mr McLelland the driver of COOL PUBLICAN regarding the incident. Mr McLelland was of the opinion that there was insufficient room for Miss Green to progress through.
--Mr McLelland confirmed that COOL PUBLICAN lost its momentum and broke due to the forward movement of EASTWOOD ALBATROSS driven by Miss Greeen.
--Miss Green acknowledged that at first she thought that there was sufficient room, particularly because her horse was hanging slightly outwards. Although, after having viewed the video clips of the incident Miss Green was of the opinion that it was extremely tight.
--After reviewing the original evidence and the video clips of the alleged incident, I found a breach of the rule had occurred in that there was clearly insufficient room for Miss Green to manoeuvre her horse EASTWOOD ALBATROSS through a gap safely and without causing an incident to either the inside or outside horse.
--Miss Green's recent driving record showed no breach of this rule in the past 12 months and also taking into account that the breach was at the low end of the scale, she was fined the sum of $200.00 and reminded of her obligations in regard to the rule.
