Decision: Mr Holmes admitted a breach of rule 858(3) in that in race 10, being the rider of TRANSCEND he weighed in 1 kg in excess of his weigh out weight of 53.5 kg
Mr Holmes admitted a breach of rule 858(3) in that in race 10, being the rider of TRANSCEND he weighed in 1 kg in excess of his weigh out weight of 53.5 kg. He was adamant he did not wish to attend the hearing and his explanation that he had a small drink between weighing out and riding was conveyed to us by Mr Davidson.

Mr Holmes has had issues with his weight but has not previously been charged under this rule this season. He should have been aware of the difficulties inherent in his having a drink, no matter how small, after weighing out.

Mr Davidson asked for a fine in the range of $150 to $200. Having regard to Mr Holmes’s explanation and his good record with respect to this rule, we fine him the sum of $200 and remind him of his obligations under the Rules of Racing.
