CHARGE
--Following the running of Race 6, Information 5256 was filed by Stipendiary Steward Mr N Goodwin under Rule 638 (2). The information stated that “D Stackhouse gave a celebratory salute prior to the winning post”.

Rule 638(2) states “A rider shall not make a celebratory gesture prior to his horse passing the winning post”.
----
Mr Stackhouse indicated the breach of the rule was admitted and also that he understood the charge and the rule it was laid under. As the breach of the rule was admitted the charge was found to be proven.

FACTS
--Mr Goodwin used the films to show Mr Stackhouse taking his hand off the reins to make a celebratory gesture two strides before the post.
----
Mr Stackhouse submitted that he thought he was past the winning post when making the gesture. Mr Hazlett indicated that it was evident from the film that the gesture was prior to the winning post, and whilst minor and at the lower end of the scale, it was still important to have consistency when the rule was breached.

SUBMISSIONS ON PENALTY
--Mr Goodwin submitted that this offending was at the lower end of the scale, and that it was Mr Stackhouse’s first charge under the rule. Mr Stackhouse and Mr Hazlett had no comments to make on a penalty.

REASONS
--The Committee reviewed the film of the incident referred to and listened to the submissions of all parties. It formed the view that the offending was at the lower end of the scale. Due to Mr Stackhouse’s good riding record under this rule, his admittance of the breach and the minor level of the offending, the Committee believed a fine would be an appropriate penalty.

DECISION
--The Committee fined Mr Stackhouse the sum of $150.
