Ms Young admitted a breach of R 869(3)(b), careless driving, in that with approximately 800 metres to run she caused interference to her own horse (MAKORA STREET) resulting in her being dislodged from the sulky. We thus find the charge proved.

Mr Knowles demonstrated on the videos that on the bend leaving the front straight for the final time Ms Young was 3 wide when Mr Orange commenced a gradual outward movement. Ms Young was not immediately following the horse in front and, as Mr Orange moved out, she came into contact with his outside wheel causing her to be dislodged from the sulky. Mr Knowles said Ms Young was careless in not taking hold of her horse or in not moving out as Mr Orange came out.

Mr Young demonstrated that MAKORA STREET had its head around just prior to the incident and had a boring pole on the outside. He said Ms Young was always going to struggle to keep MAKORA STREET off Mr Orange’s wheel. He said the defendant was a victim of circumstances.

Mr Knowles produced Ms Young’s record which evidenced one previous breach of this Rule in April last when she was fined $200. He described the incident as top end and asked for a minimum suspension of 4 weeks. Ms Young indicated she only had one drive per meeting. We considered a combination of a fine and suspension but we are not satisfied Ms Young could meet a substantial fine. We thus impose a suspension only. We agree the breach is at the higher end but have regard to the fact MAKORA STREET is not the easiest horse to drive. We give credit for the guilty plea. We suspend Ms Young from the end of racing today up to and including 28 November. She will thus be able to drive at the Banks Peninsula meeting on the 29th. This suspension is 5 weeks, but reflects the fact that Ms Young usually only has one drive per meeting.
