An information, under Rule 869 (4) & (8), filed by Chief Stipendiary Steward Mr N Escott instigating a protest on behalf of BIELLA STAR driven by Mr R Holmes which was pulled up, against ROCKET REIGN driven by Mr J Dunn, placed 2nd on the grounds of interference shortly after the start.

Mr Holmes represented the connections of BIELLA STAR, and Mr Dunn and part owner Mr R Sandford the connections of ROCKET REIGN.

Mr Holmes said he was trailing Mr Herlihy's horse. Mr Dunn moved his horse outwards into the one off position, which checked BIELLA STAR, which then broke. He thought Mr Dunn's horse had been interfered with by the horse in front of it. Stipendiary Steward Mr J Muirhead showed the video film of the incident. He said GOTTA GO CULLEN was outside Mr Dunn and BIELLA STAR behind that horse. He said Mr Dunn moved outwards to avoid MR MOLLY which had broken. He said Mr Dunn had options of taking hold of his horse or moving outwards. He said Mr Dunn elected to move outwards. Mr Dunn said he took evasive action - he would have been in more trouble if he hadn't - he referred to the speed of the horses - he said his horse's leg touched the outside sulky wheel of Mr Molly. Mr Holmes said he thought Mr Dunn had done what he thought was the right thing - it was natural instinct - a safety issue. However he conceded to Mr Escott that outward movement was subject to not causing interference. Stipendiary Steward Mr T Taumanu said it was the manner in which Mr Dunn came out that was the problem. Mr Sandford suggested Mr Holmes' horse was running inwards and said Mr Dunn had taken evasive action.

DECISION & REASONS

--

Mr Dunn moved ROCKET REIGN outwards to avoid the breaking MR MOLLY. However ROCKET REIGH was not hard on the back of MR MOLLY. The Committee accepts the evidence of Mr Muirhead that Mr Dunn had the option of taking hold of his horse. The outward movement when there were horses racing outside ROCKET REIGN meant it was almost inevitable there would be interference. Mr Dunn should have taken hold of his horse. The outward movement of ROCKET REIGN caused interference to BIELLA STAR with resultant interference to EBONY GEM. Both horses broke. The chances and progress of both horses were affected. The protest is upheld. Because of the consequences of the interference the Committee exercises its discretion to relegate ROCKET REIGN to immediately behind BIELLA STAR, the amended placings being :
