Following the running of Race 3, the Nevele R Fillies Series Consolation, an information was laid by Chief Stipendiary Steward Mr N. R. Escott against Mr G. J. Lee, the driver of SEASWIFT PRINCESS (6), alleging that Mr Lee had committed a breach of Rule 869(2)(a) in that he used his whip excessively in the run home.

Following the running of Race 3, the Nevele R Fillies Series Consolation, an information was laid by Chief Stipendiary Steward Mr N. R. Escott against Mr G. J. Lee, the driver of SEASWIFT PRINCESS (6), alleging that Mr Lee had committed a breach of Rule 869(2)(a) in that he used his whip excessively in the run home.
----Mr Lee had indicated on the information that he admitted this breach of the Rules and he confirmed this at the hearing.
----Mr Escott used video coverage of the final stages of the race to show that Mr Lee had used the whip on about 17 occasions in the straight. Mr Lee accepted that the use of the whip looked bad, although he also said that he had not hit the horse on every occasion.
----Penalty: Mr Escott advised that it should be taken into account that Mr Lee had admitted this breach of the Rules, and he had no previous convictions. A fine of $200-00 was recommended.
----Mr Lee had no relevant submissions to make regarding penalty.
----We were satisfied that a fine of $200-00 was appropriate in this case and Mr Lee was fined this amount.
