Decision:

Following the running of race 9, the Night Eruption Handicap, Ms Taylor was charged with careless riding under rule 638 (1) (d).  The information alleged that “she allowed her mount THE CAPTAIN to shift out when not sufficiently clear causing BASES LOADED (O Bosson) and CHERRY EXPRESS (S Doyle) both to be checked near the 200 metres”.



Following the running of race 9, the Night Eruption Handicap, Ms Taylor was charged with careless riding under rule 638 (1) (d).  The information alleged that “she allowed her mount THE CAPTAIN to shift out when not sufficiently clear causing BASES LOADED (O Bosson) and CHERRY EXPRESS (S Doyle) both to be checked near the 200 metres”.

Rule 638 (1) (d) states “A rider shall not ride a horse in a manner which the Judicial Committee considers to be .....careless”

Ms Taylor, who was assisted by her employer licensed, trained Mr K Gray, indicated on the information she admitted this breach of the rules.  She also agreed she understood the charge and the rule it was laid under.  As the breach of the rule was admitted the charge was proven.

Stipendiary Steward Mr Goodwin showed the head on and side on videos of the incident.  Mr Goodwin pointed out Ms Taylor was immediately behind the leader at the 200m mark.  At that point she commenced to move outwards taking the rightful line of Mr Bosson and Mr Doyle who both received bad tightening.  Mr Goodwin said Ms Taylor had been impatient and was only 1 length clear when she commenced moving out.

Mr Gray said the film was quite clear and Ms Taylor had moved out when she shouldn’t have and was guilty of careless riding.
 
Penalty Submission

Mr Goodwin said this was Ms Taylor’s first charge under this rule.  He said she was a promising apprentice who did not cause the stewards any problems and the incident today was clearly linked to her relative inexperience.  He didn’t think she should be severely punished and said the stewards thought the incident was at the low end of the scale.  He further said that as an apprentice Ms Taylor would not learn from this by having to sit out a lengthy suspension.

Mr Gray said he did not believe the incident was a serious one but he accepted a period of suspension was to be expected.

Decision

--

In coming to a decision on penalty the Committee considered the incident as shown on the video and all the submissions put before it.  We have taken into account Ms Taylor’s admittance of the breach and her excellent riding record prior to today.  However, the video clearly shows you did push out when not sufficiently clear of both Mr Bosson and Mr Doyle.  Up to the time of the incident you have ridden a very good race but at the 200m mark in moving out when not the required distance clear you have clearly ridden in a careless manner.  We do, however, agree that the offending is at the lower end of the scale.

Ms Taylor is suspended from the conclusion of racing on Sunday 15 November 2009 until the conclusion of racing on Saturday 21 November 2009, that being 4 riding days.
