As a result of Apprentice Jockey Mr H Hooper being unable to claim his allowance down to his racing weight of 53 kilogrammes he was charged with a breach of Rule 520 (4) (c) of the Rules of Racing because of the fact that his weight was 11/4 kilogrammes in excess

As a result of Apprentice Jockey Mr H Hooper being unable to claim his allowance down to his racing weight of 53 kilogrammes he was charged with a breach of Rule 520 (4) (c) of the Rules of Racing because of the fact that his weight was 11/4 kilogrammes in excess. He was replaced by Apprentice Jockey A M Munday.
--Mr Hooper pleaded guilty to the charge which is therefore deemed to be proved.
--The evidence was self-explanatory. By way of explanation, Mr Hooper said that he had relied on his household scales, which always seemed to match the scales at Riccarton Park Racecourse.
--Mr Ching confirmed that Mr Hooper had not been charged with this offence before, and that he had a good record. Mr Hooper was supported by his employer, Mr M Pitman, who spoke well of Mr Hooper and confirmed that the remorse expressed by Mr Hooper for his error was genuine.

The following oral decision as to penalty was delivered on Race day.
--We have taken into account the evidence in relation to this charge. It is of concern to this Committee of course that you have, to all intents and purposes, broken three riding engagements today. Whilst we accept what you say about your household scales, they can be inaccurate, and you should really only use those as a guide.
--We note your good record. We note the remarks made by Mr Pitman on your behalf. It is encouraging to hear the good things said about you.
--We agree that a fine is an appropriate penalty. We set the fine at $125.00.
