| -- Information 41413 has been filed by Stipendiary Steward, Mr AR Coles, requesting a ruling in respect of Rule 864(5) that race 7 should be null and void as the starter had declared a false start and a re-run was not appropriate due to the number of horses who completed the distance. ----The starter, Mr T Harrison, confirmed that a false start had been declared and the siren had been sounded. ----Mr Coles asked the Committee to note that as a false start had been declared there was no discretion under the rule to vary his decision which in this situation is final and subject to no appeal. The discretion conferred by Rule 864(5) does not apply and is limited to where a race is declared void, to whether the horses may be started again as soon as possible. ----Mr J Boyle, the Avondale Jockey Club President, acknowledged that the Club accepted this and the Committee accordingly ruled, as requested, that Race 7 should be null and void and that no re-run would be ordered due to the number of horses who had completed the distance following the false start. |
