DECISION AND REASONS:
--Following the running of Race 2, Rangiora New World Pace, an information instigating a protest was filed by Stipendiary Steward, Mrs K R Williams, against MELISSA ROSE (D J Butt), placed 4th by the judge, on the grounds of a breach of the above Rules and Regulation in the run home.
--Mr Butt, the driver and co-trainer of MELISSA ROSE, was present at the hearing of the information.
--Mr Butt waived reading of the Rules and Regulation.
--At the outset of the hearing, Mrs Williams acknowledged the absence of a true head on video replay of the run home. She informed the Committee that the Stipendiary Stewards were alleging that Mr Butt, who was running 3-back on the marker line, improved through into the passing lane and attempted to improve where there was insufficient room and struck four pylons in the home straight. SIR VANDELL (C T Woodward) had been the trailing horse and was entitled to full access to the passing lane. She alleged that it was not apparent from the video replays available that either the leader, THINK BIG, or SIR VANDELL had run in and tightened Mr Butt. Mr Butt had continued to drive his horse and had struck the pylons when he need not have been there. Mrs Williams conceded that it was not apparent from the video replays that Mr Butt had gone inside the markers in terms of Rule 869 (7B) but submitted that Mr Butt had, in any event, gained an advantage.
--Mr B D Williams, Stipendiary Steward, showed the video replays of the run home. He pointed out SIR VANDELL take the passing lane at which point there was some room for MELISSA ROSE to improve into on the inside of SIR VANDELL. From that point, Mr Butt knocked over four marker pylons. Mr Williams said that there appeared to be no inward movement by either THINK BIG or SIR VANDELL. The obligation was on Mr Butt to ensure that a full run was available. Mr Butt had stopped driving when he realised there was insufficient room and he had not been able to pass any of the horses in front.
--Mr Butt said that when he entered the passing lane initially, he had "heaps of room". He alleged that THINK BIG had run down slightly all the way down the home straight and tightened him and, further, that he had not actually gone inside the markers but had struck them on the outside.
--Mr Woodward, when questioned by Mr Butt, stated that THINK BIG had moved down slightly on top of him over the last 100 metres. Mr Butt demonstrated this on the video replay and showed Mr Court, the driver of THINK BIG, pull it out nearing the finish when he became aware it was getting tight. From this point, some 40 metres from the finish, Mr Butt said that he had plenty of room again. He referred to the lack of a head-on replay.
--The Committee was of the view that Mr Butt had possibly gone inside the four track markers but it could not be satisfied on the matter because of the lack of a true head-on video replay. The videos available did not show his sulky wheel going inside any markers, although it could not be disputed that four markers had been knocked over. The Committee noted that MELISSA ROSE finished only 4th and it could not be argued that the horse had finished in a higher placing than it would otherwise have as a result of any possible breach of the Rules. There was no satisfactory evidence adduced that a breach of Rule 869 (7B) had occurred, so any relegation or disqualification was at the discretion of the Committee. The Committee did not need to address the issue of whether or not there was any interference to MELISSA ROSE by way of being tightened in the run home. In terms of Rule 869 (8) no advantage had been gained given the margin between 4th and 5th which, from looking at the video, was several lengths.
--Accordingly, the protest was dismissed and placings for the race stand.
