DECISION AND REASONS:
Following the running of Race 6, Nevele R Fillies Series Heat Mobile Pace, Information No. 68328 was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Open Driver, Mr C J De Filippi, alleging a breach of Rule 869 (3) (b) in that Mr De Filippi, as the driver of OUR PRINCESS ROYAL, allowed that horse to strike the sulky wheel of INDULGE with approximately 200 metres to run as a result of which OUR PRINCESS ROYAL broke and lost all chance.

DECISION AND REASONS:
Following the running of Race 6, Nevele R Fillies Series Heat Mobile Pace, Information No. 68328 was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Open Driver, Mr C J De Filippi, alleging a breach of Rule 869 (3) (b) in that Mr De Filippi, as the driver of OUR PRINCESS ROYAL, allowed that horse to strike the sulky wheel of INDULGE with approximately 200 metres to run as a result of which OUR PRINCESS ROYAL broke and lost all chance.

Mr De Filippi was present at the hearing of the information and indicated that he admitted the breach. The breach was found proved accordingly.

Rule 869 provides as follows:
(3)   No horseman in any race shall drive:-
      (b)    carelessly.

--

Mrs Williams showed video replays of the final 300 metres of the Race. She pointed out OUR PRINCESS ROYAL racing one-back and 3-wide behind INDULGE (D J Butcher). At that point, Mr De Filippi attempted to come out and, in so doing, the horse’s near front foot struck the sulky wheel of INDULGE. Mr De Filippi had to restrain the horse which broke and lost its chance.

Mrs Williams informed the Committee that the Race was heat for a $150,000 race. The horse lost an opportunity of qualifying for that final and the connections of the horse and punters were deprived of an opportunity.

Mrs Williams sought a fine of $400 and she referred to the JCA Penalty Guide.

Mr De Filippi said he was driving the filly in a race for the first time. He had driven her in a workout when she had been lazy and lost ground when coming off another runner’s back. He said that he had “only just nicked the wheel”. It was the slightest touch and the contact was made at the point of the stride. He submitted that the contact was barely discernible on the replay. The filly also had a long reach.

Mrs Williams said that Mr De Filippi had a clear record under the Rule in the last 12 months. Mr De Filippi asked the Committee to take into account the number of drives that he has.

The Committee noted that the starting point under the JCA Penalty Guide is a fine of $400 and/or a suspension for 2 weeks. Taking a fine of $400 as a starting point in this case, the Committee in arriving at penalty, took into account Mr De Filippi’s frank admission of the breach and his excellent race driving record in the past 12 months. In addition, the Committee was of the view that the degree of carelessness was at the lower end of the scale.

Mr De Filippi was fined the sum of $300.
