----Mr C. W Johnson admitted a charge of careless riding under rule 871(1)(d) in relation to his ride on STRIKING in the Gallipoli 2200.
----Mr L. N. McCutcheon, Chief Stipendiary Steward, used the head on, side and rear films of the field entering the finishing straight to show Mr Johnson turn STRIKING in on the rightful running line of MUY BUENO (J. Bullard) which had moved up to the hind quarters of STRIKING in a gap between it and a horse on the inside. Mr Johnson maintained this pressure on MUY BUENO which was severely jostled and eventually closed out of the gap and subsequently denied a run.
----We find the breach proved.
----On the issue of penalty Mr McCutcheon advised that Mr Johnson had one such previous charge on 11 January 2006 since his return to riding. He submitted that the jostling and interference caused to MUY BUENO extinguished that horse's chances and that a period of suspension was called for.
----Mr Johnson acknowledged there was a run for Mr Bullard but wondered whether other horses shifting in might have contributed to the incident. He thought he maintained a fairly straight line but beyond that left it to the Committee to set the penalty.
----There is not a scintilla of support in the films for Mr Johnson's interpretation of events. We find a troubling feature of this incident to be the manner in which Mr Johnson turned his mount into MUY BUENO?S running line and then made no effort to relieve the subsequent pressure to that horse. Mr Johnson's actions extinguished the chances of MUY BUENO.
----The degree of carelessness exhibited commands a period of suspension and in fixing that we have extended a degree of mitigation for Mr Johnson's riding record and his candid admission of the matter.
----Pursuant to rule 1122 Mr Johnson is suspended from the close of racing on Wednesday 25 January 2006 until the close of racing on Thursday 2 February 2006.
