Following the running of race 3 The Harrisons Nurseries Metric Mile a protest was lodged by stipendiary steward N Goodwin alleging that the horse POP THE PIRATE provisionally placed first by the judge, interfered with the chances of CANY FLY provisionally placed third by the judge, and LUCKY COMBO provisionally placed fourth by the judge
Following the running of race 3 The Harrisons Nurseries Metric Mile a protest was lodged by stipendiary steward N Goodwin alleging that the horse POP THE PIRATE provisionally placed first by the judge, interfered with the chances of CANY FLY provisionally placed third by the judge, and LUCKY COMBO provisionally placed fourth by the judge. The margins were long neck, long neck,? length and three lengths.
--Mr Goodwin showed the available film to all parties. He alleged that POP THE PIRATE, approximately 50 metres short of the line, moved out, took the line of and caused interference to CANY FLY and LUCKY COMBO by its movement outwards.
--Both head and side on films were shown.
--Miss Murray answered a question from Mr Goodwin and said that her mount was squeezed out of a gap and, yes, she did lose ground, approximately ? a length, at the point of contact. She confirmed that she did have to stop riding for about six or seven strides. She confirmed that she also stopped riding when coming into a gap she was perfectly entitled to take. She believed she lost ? length.
--Mr Myers asked if the horse on the outside KIPLING moved inwards and contributed to the incident. Miss Murray informed the committee that she did not believe that horse moved inwards and contributed to the incident in any way.
--Mr Goodwin informed the committee that the films available showed clearly the movement of POP THE PIRATE over the final stages causing tightening. He advised that both riders had to stop riding and both were entitled to be where they were.
--Mr Myers, in making his submission informed the committee that POP THE PIRATE had come from behind, and also submitted there was inward movement from KIPLING, the widest runner. He also questioned whether Miss Houston and Miss Murray were riding on a loose rein when the alleged interference occurred.
--Miss Lockett, in her submission acknowledged there was contact between her mount and Miss Houston's mount and also re emphasized Mr Myers' point that she came from behind the other runners and in her view they had come to the end of their runs.
--DECISION AND REASON
--Rule 876 (1) asks this judicial committee to consider a number of issues pertaining to this protest. Firstly did interference occur, and, secondly if it did occur did that interference affect the chance of the horse or horses interfered with from finishing in a higher placing.
--Thirdly, this committee has the discretion to alter the provisional placings accordingly.
--The committee after viewing the available films and considering the evidence placed before us were convinced the interference did take place. POP THE PIRATE clearly moved outwards causing interference to two horses. Both CANY FLY and LUCKY COMBO were perfectly entitled to be where they were. Both of the affected riders did have to stop riding and in Miss Houston's words she had to stop riding for six or seven strides.
--We are of the opinion that the movement of POP THE PIRATE outwards, while affecting the two horses did contribute to LUCKY COMBO being more severely affected by having CANY FLY take its line by the actions of the provisional winner POP THE PIRATE.
--Comment was made by Mr Myers and Jockey Lockett that the horse KIPLING finishing strongly down the outside contributed to the incident by moving inwards. We rejected that argument completely. KIPLING?S movement inwards, if any, contributed nothing to the interference suffered to the horses on his inside.
--We have used our discretion in upholding the protest by relegating the provisional winner. The placings now read :
--1st - 5 KIPLING
--2nd - 4 CANY FLY
--3rd - 1 LUCKY COMBO
--4th - 7 POP THE PIRATE
--On the recommencement of the hearing to announce our decision Mr K Myers could not be contacted. He had left the vicinity of the judicial room.
