| -- DECISION AND REASON ----Following the hearing into the protest against CEE H BEE which was disqualified for starting from the wrong barrier position a charge under Rule 862(2) was brought against Mr G Smith, Junior Horseman, for allowing his horse to start from the wrong barrier position. ----The Chairman read his decision in the protest in full and it was agreed by all parties that the evidence is taken as read. ----Mr Smith admitted the charge but stressed that his was a difficult horse to drive and he did not want to fight him to ensure he went away. Under Rule 1111(1)(d) the charged was proved. ----Submissions as to penalty were heard. Only one other case could be quoted, that of C Barron at Forbury Park, who it stated was fined $250. ----Mr Smith's inexperience was taken into account, and he was fined $200. |
