Decision:

Rule 869 (4a) & (8) : An information instigating a protest filed by Stipendiary Steward Mr J. Muirhead on behalf of STILETTO POINT driven by Mr A.G. Herlihy, placed 13th against JABAL AKDAR driven by Mr D. Moore, placed 4th on the grounds of interference leaving the home straight shortly after the start.



Rule 869 (4a) & (8) : An information instigating a protest filed by Stipendiary Steward Mr J. Muirhead on behalf of STILETTO POINT driven by Mr A.G. Herlihy, placed 13th against JABAL AKDAR driven by Mr D. Moore, placed 4th on the grounds of interference leaving the home straight shortly after the start.  Mr Moore, part owner and driver represented the connections of JABAL AKDAR.  Mr Muirhead demonstrated the incident by way of the video film.  He said that as the horses were leaving the home straight JABAL AKDAR moved inwards and its sulky wheel got under STILETTO POINT causing that horse to move inwards over the marker pegs and then to break and lose its chance.  Mr Herlihy said his horse had been pushed down on to the marker pegs by Mr Moore’s horse, his horse hit a marker peg and broke.  Mr Moore, after viewing the film acknowledged that his horse had tightened Mr Herlihy’s horse and thereby he effectively conceded that the protest was made out.

Decision:

The committee accepted the evidence of Mr Muirhead and Mr Herlihy.  Their evidence was confirmed by the video film.  Mr Moore did not contest their evidence and indeed acknowledged that JABAL AKDAR had moved inwards and tightened STILETTO POINT.  This is a clear cut case of interference resulting in the chances of STILETTO POINT being extinguished.  The protest is upheld and JABAL AKDAR is disqualified.  The placings then being:
