This is an information filed by Stipendiary Steward Mr J MUIRHEAD against Mr J STORMONT driver of ERIDANUS alleging a breach of the above rule in that he failed to bring his horse up to the mobile barrier prior to the start of the race.

This is an information filed by Stipendiary Steward Mr J MUIRHEAD against Mr J STORMONT driver of ERIDANUS alleging a breach of the above rule in that he failed to bring his horse up to the mobile barrier prior to the start of the race. 
Mr STORMONT admitted the breach and did not wish to be present at the hearing.

Stipendiary Steward Ms K WILLIAMS showed the video film of the incident.  ERIDANUS drew barrier position seven on the front row.  It was one length from the barrier when the starter released the field.

PENALTY

Ms WILLIAMS said the recommended starting point was a fine of $250 which she recommended even though this was a group one race.

In fixing penalty the committee takes into account the guilty plea, the recommended starting point and the submission of Ms WILLIAMS.  Mr STORMONT has no relevant breaches of the rules recorded against him.  Although this was a group one race, Mr STORMONT was unlikely to attempt to go forward from such a wide barrier position.  In addition, ERIDANUS was only one length from the barrier.  This breach is highly unlikely to have had any effect on the chances of the horse.  The offending is at the lower end on the scale of seriousness.

Balancing those matters a fine of $250 is imposed.
