Following race 3 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendary Steward Mr C George, that J Waddell angled his mount GRAND STATESMAN out when not clear of FIRE STORM

DECISION & REASON:
--Following race 3 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendary Steward Mr C George, that J Waddell angled his mount GRAND STATESMAN out when not clear of FIRE STORM ( C Lammas) causing that horse to check, near the 300 metre.
--Mr Waddell did not admit the charge.
--Mr George demonstrated the video which showed Mr Waddell, as the field moved past the 300 metres, angle his mount out for a run. He was not, Mr George claimed, entitled to do so as Mr Lammas on FIRE STORM was racing on his outer. The result was that FIRE STORM suffered a check as his line was taken.
--In reply Mr Waddell claimed that although he was not the reqired distance clear of FIRE STORM his line was dictated by the outward movement of KAYJAYS ROCKET.
--Mr George said that, in his view, KAYJAYS ROCKET did move out a little but not till after Mr Waddell had taken FIRE Storm's line. He confirmed this on the video. He also claimed that KAYJAYS ROCKET was sufficiently clear of GRAND STATESMAN at that stage.
--We have reviewed all of the evidence. In our view although KAYJAYS ROCKET did move out we do not consider it was responsible in dictating GRAND Statesman's line.
--Mr Waddell was, on his own admission, less than the required distance clear when he elected to make the outside run. We therefore find him guilty as charged.
----PENALTY:
--Mr George gave Mr Waddell's record and also added that he felt the offence was serious and asked for a suspension.
--Mr Waddell stated that he had intended to ride at all meetings in the country in coming weeks.
--The committee agrees with Mr George that the nature of the offence deserves a suspension as penalty. We therefore suspend Mr Waddell from riding from the conclusion of racing on 13 September till the conclusion of racing on 20 September 2006.
