Following the running of race number 10 the Stipendiary Stewards lodged an information pursuant to Rule 303 (2) alleging that Mr White used abusive language towards the starter, Mr P Lamb, prior to the start of the race.

DECISION & REASON
--Following the running of race number 10 the Stipendiary Stewards lodged an information pursuant to Rule 303 (2) alleging that Mr White used abusive language towards the starter, Mr P Lamb, prior to the start of the race.
----At the outset of the hearing Mr White confirmed that he admitted the breach and that he wished to be heard at the hearing.
----Mr P Lamb, the starter, said as the field was lining up Mr White's horse backed out, he was asked to bring his horse up, he did so but then the horse backed out again and turned in the opposite direction. Mr Lamb then required Mr White's horse to start from the outside of the front line. He further said that as Mr White was taking his horse into the new starting position the language complained of was used towards him. He also said that after the race Mr White continued with his horse round into the back straight and made further comments to him.
----Mr White said that prior to the start Mr Lamb had indicated that there was plenty of time, that his horse backed out, he attempted to bring it in, it then backed out and turned round again and he was sent to the outside. A decision he thought was harsh. He accepted that he used the language complained of to Mr Lamb at that stage but also said that when he proceeded round to talk to Mr Lamb after the race he did not use abusive language.
----In respect of penalty the Stipendiary Stewards suggested that a fine would be appropriate as this was Mr Lamb's first offence under that type of rule and indicated that the only previous charge under the rule was a $500 fine imposed, however, it was accepted that the circumstances of that charge were different from this one.
----Mr White indicated that he preferred a suspension.
----The charge is accordingly found proven and in respect of penalty the Committee suspends Mr White's horseman's licence on the completion of racing today until the completion of racing on 23rd December 2006 (an effective 2 day penalty).
