Mr. PT Holmes, an apprentice jockey was charged with careless riding pursuant to Rule 871(1)(d) of the Rules of Racing as a result of an incident in Race 7 at the North Canterbury meeting held at Riccarton Park on Friday 22nd December 2006.

The information alleged:

"P Holmes, the rider of "Quantum Dude" with approximately 400 metres to run allowed his mount to take the line of "Al Farouk" (J Bullard) causing "Al Farouk to check."

After hearing the evidence, the panel retired and then delivered the following oral decision.

Oral Decision

--

"Mr. PT Holmes has been charged with careless riding pursuant to Rule 871(1)(d) of the Rules of Racing.

--

The essence of the Stipendiary Stewards case is that Mr. Holmes was not his own horse's length and another length clear of JS Bullard's mount "Al Farouk" when moving outwards to secure a line to the finishing post.

--

After hearing from Mr. Ching and Mr. JS Bullard, and from Mr. PDJ Harris on behalf of Mr. Holmes, and after looking carefully at the video coverage, we find ourselves in a situation where we are not satisfied that Mr. Holmes did move across so as to take the line of Mr. Bullard's mount and thereby riding carelessly.

Because we are not satisfied, the information is dismissed."

Mr. SC Ching, following the running of Race 7 at Riccarton Park on 22nd December 2006, charged PT Holmes, an apprentice jockey with careless riding. He alleged that Mr. Holmes allowed his mount to take the line of "Al Farouk" at about the 400 metre mark, causing "Al Farouk" to check.

He called Mr. JS Bullard to give evidence about the incident. Mr. Bullard alleged that he received interference. He said that he was running back in the field and about the 400 metre mark, that he angled his horse outward, called out to Mr. Holmes, who then moved his mount out when not his own length and another length clear. Mr. Bullard alleged that Mr. Holmes mount moved out "about ? a horse width." Mr. Bullard believed he had room to improve around the outside of Mr. Holmes at the relevant time.

Mr. Harris on behalf of Mr. Holmes did not at this point of the proceeding, have any questions of Mr. Bullard.

Mr. M Humphreys, Assistant Stipendiary Steward, then demonstrated the incident from the video coverage.

The video coverage showed how the field, about the 400 metre mark was making an outwards movement to the outside of the track. (It should be noted that the track conditions were "Slow" and the field was endeavouring to find better footing on the outside.) "Quantum Dude" was improving well at the time and found racing room on the outside of other horses. "Al Farouk" was racing in the clear and was also improving. Mr. Bullard took "Al Farouk" to a similar line to that being taken by Mr. Holmes. Mr. Bullard appeared to get "Al Farouk" quite close to "Quantum Dude". Mr. Holmes moved his horse close to the fence at this point, and the video coverage revealed that he looked back at this time. Mr. Bullard then took his horse around the hindquarters of "Quantum Dude", in his run to the finishing post.

Mr. Harris was again given the opportunity of asking questions of Mr. Bullard. He asked if Mr. Holmes actions "cost Mr. Bullard the race". Mr. Bullard responded by saying that he had not lodged a protest and that the hearing was about whether or not MR Holmes rode carelessly.

Mr. Harris then gave a statement on Mr. Holmes behalf, asserting that there was no case to answer. He maintained that "Quantum Dude" had secured his position on the outside rail and that Mr. Holmes was sufficiently clear at the relevant time.

In answer to a question from the Chairman, Mr. Holmes said that at the point where he looked backwards was the point when he heard Mr. Bullard call out. He also said that he was unaware of the position of "Quantum Dude" until such time as he heard Mr. Bullard's call.

Mr. Ching then summarized by stating that what had to be considered was whether or not Mr. Holmes was sufficiently clear at the time he crossed over. He further stated that it was the Stipendiary Stewards view that "Al Farouk" had its "head in the gap" and therefore, emphasized that the charge had therefore been made out.

The panel retired to consider the evidence. After looking at all matters in detail we were left in doubt. There was no real evidence of a "check" of any significance to "Quantum Dude". Mr. Holmes, seemingly, did not know of Mr. Bullard's presence at the time he moved to the outside rail. That in our view was a reasonable assumption for Mr. Holmes to draw having regard to the position he was in at the time. We also did not form the view from the video coverage that the horses were as close together as alleged.

Because the panel was left in doubt, the information was dismissed.
