Following the running of Race 1 at Hawkes Bay RI, Jockey K Smith was charged under Rule 871 (1) (D) in that he angled his mount , WAILEA MISS, outwards near the 250 metre mark when not sufficiently clear of ECSTACY

Following the running of Race 1 at Hawkes Bay RI, Jockey K Smith was charged under Rule 871 (1) (D) in that he angled his mount , WAILEA MISS, outwards near the 250 metre mark when not sufficiently clear of ECSTACY (K Myers), who was forced outwards causing a severe check to SWEET CHARIOT (S Collins) and interference to IPANEMA (P Bell). Mr Goodwin, after reading the rule asked Stipendiary Steward Mr J Oatham to demonstrate the alleged incident on the available films.

Mr Oatham informed the committee that the severe tightening to SWEET CHARIOT was caused by Mr K Smith not being sufficiently clear of Miss Myer's mount ECSTACY when he pulled out to make his run. He believed that Mr Smith angled his mount out with little regard to the horses around him. He felt that it was very lucky heels were not clipped during the incident. Mr Oatham did confirm that after the incident Jockey Smith took corrective action but by then his mount had moved in about 3-4 horse widths and that he was no more than a neck from Miss Myers's mount when he angled out. He informed the committee that Mr Smith's mount moved outwards onto Miss Myer's mount a few strides further on.

Mr K Smith told the committee he was on a winning chance. He believed Miss Myer's mount over reacted and that the incident looked worse than it was. He was asked by the chairman to point out on the film where he felt Miss Myer's mount over reacted when he angled out. This he was unable to do. He admitted the contact was made to Miss Myer's mount and that caused her to be shunted sideways. Miss Myer's mount, he believed moved from 5 wide to one off therefore contributing to the incident.

SUBMISSIONS ON PENALTY

Mr N Goodwin, Stipendiary Steward, informed the committee that K Smith was last charged under this rule in May 2005 and was suspended for five days. He believed, however, it was a very serious breach of the rule. One at the top end of the scale. He asked for a period of suspension of five days.

Mr K Smith asked the committee to take into account his admittance of the breach, his good record considering he averages about 4 rides a race day and that although he rides solely in the C D District he doesn?t get many good rides.

PENALTY AND REASON

--

Mr Smith, the committee in reaching its decision to impose a period of suspension under this charge has taken into account your admittance of the breach, the fact that you were last charged under this rule in 2005 and that you ride only in the C D District.

--

However, we concur with Stipendiary Steward Goodwin when he told us this was a serious breach of the rule. One at the top end of the scale. You placed yourself, other riders and their mounts in positions where chances were extinguished and severe buffeting and interference occurred. Three other horses were involved. In the committee's opinion it was very fortunate that heels were not clipped in the incident. We were concerned that your deliberate action in pulling out onto Miss Myer's mount was taken with little regard of the horses around you.

The committee, because of your actions, was unable to find any reason to allow any mitigating circumstances to be reflected in the penalty. Taking into account the serious nature of the incident we were of the opinion that the period of suspension must reflect the seriousness of the incident.

Consequently this committee has decided to suspend you from race riding after the completion of racing on Tuesday 2 January2007 until the completion of racing on Monday 22 January 2007.
