Facts:
Following the running of race 5, HIREPOOL ACCESS 1600, an Information was filed pursuant to rule 330 (3)(c). The Informant, Mr Williamson, alleged that Mr Hutchings was unable to make the handicapped weight for GIN SWING.
Mr Hutchings acknowledged that he understood the nature of the charge, the rule and confirmed his admission of the breach. Mr Hutchings advised the Committee that he did not require any assistance at the hearing.
Rule 330(3) (c) provides:
“A rider shall not fail to ride a horse at the weight at which it is handicapped to race”.
Mr Williamson advised the Committee that Mr Hutchings was more than 0.5kgs over the handicapped weight (57kgs) and was replaced by Mrs Allpress.
Mr Hutchings said he was living in Sydney and his plane arrived late last night which prevented from having a sauna. He confirmed that he had a sauna this morning but was unable to shed the excess weight.
Submissions for Penalty:
Mr Williamson produced Mr Hutchings' record which showed 1 previous breach under this rule in the last 120 days in New Zealand. He said this breach would normally be dealt with by way of a minor infringement. However he informed the Committee that Mr Hutchings has incurred recent fines in Australia for being overweight, the latest being on 30 September 2015. He submitted a fine in the vicinity of $200 would be appropriate.
Mr Hutchings confirmed that he had breached the overweight rule in Australia on several occasions where no weight variance is allowed. He submitted a fine of $200 which was similar to his last breach in New Zealand would be acceptable.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. The mitigating facts were the circumstances of the plane being delayed was beyond Mr Hutchings' control and his admission of the breach for which he has been given credit for. The Committee notes that Mr Hutchings' record in Australia is not good and before fixing penalty we referred to similar breaches of this rule which showed a $225 fine was the consistent penalty imposed.
After taking into account all of the above the Committee considers an appropriate penalty is a fine of $225.
