Decision:

The committee found a breach of the rule proven.

Penalty:

Mr Armour was fined the sum of $200.  The committee in fixing penalty took into account Mr Armour's excellent driving record over the past twelve months and also the fact that he was a busy driver and that the degree of carelessness on this occasion was relatively minor.

 

 

Charge:

An information (68873) was laid by Stipendiary Steward Mr C J Allison after the running of race 9 the Southland Standardbreed Breeders Assn Fillies & Mares Mobile Pace alleging that under rule 869(3)(b) that horseman A M Armour(Eilis Rose) shifted ground inwards when insufficiently clear of Easton All Action (B M Norman) causing Easton All Action to break.

Facts:

Stipendiary Steward Mr Allison showed the committee several video clips of the alleged incident highlighting Eilis Rose moving forwards in the three wide position in the front straight on the first occasion.
 
Mr Allison pointed out to the committee that Easton All Action driven by B M Norman was racing in the two wide position and approximately 1 1/2 lengths behind Eilis Rose initially at which point Mr Norman urged his horse forward and closed the gap which in Mr Allison's opinion he stated that Mr Norman was entitled to do.
 
Mr Allison then highlighted Mr Armour attempting to move into the gap which had closed to about 1 length and as a result of this whilst Mr Armour completed the manouvere successfully Mr Norman had to take a hold of his horse to ensure no contact was made.
 
Mr Allison stated that Mr Norman's horse was seen to become unbalanced and went out of it's gait losing it's chance.

Submissions for Decision:

Mr Norman stated that his horse had broken because there was insufficient room for his horse to continue it's momentum when Eilis Rose had moved into the gap that his horse had moved into.  Mr Norman also stated that he had restrained his horse.Mr Norman stated that no contact had been made between his horse and Mr Armour's.
 
Mr Allison agreed that no contact had been made but that contact did not necessarily have to be made for interference to occur.
 
Mr Armour stated that he believed there was sufficient room for his horse Eilis Rose to move into the gap and that Mr Norman had hunted his horse up into the space but there was still enough room for his horse to enter into.  Mr Armour also stated that he believed the horse Easton All Action was racing greenly and had done so in a previous start and that on this occasion he had broken 3 or 4 strides after he had put his horse into the space.

Reasons for Decision:

The  Committee was satisfied that Mr Armour has moved his horse Eilis Rose inwards when there was clearly not enough space to do so and as a result has caused Easton All Action to be checked and eventually break losing it's chance.

Stipendiary Steward Mr Allison stated that Mr Armour was a senior horseman who had an excess of two hundred race day drives this season and had no previous breaches under this rule in the past twelve months.  Mr Allison also stated that he believed that the range of carelessness was at the lower end of the scale.
 
Mr Armour stated that the season in Southland was winding down and that he normally drove four to five horses at most race meetings in the height of the season.
