Ms Johnson admitted the charge, which consequently is proved.

Penalty:

Accordingly, she is suspended from 4 November 2020 to 10 November 2020 inclusive - effectively 5 National Riding Days.  Such a term of suspension enables her to ride at Ellerslie on 3 November 2020 and at Riccarton on 11 November 2020 and thereafter.

Facts:

After the running of Race 3, the DONAGHYS PRO-ABAMEC 1400, Mr A Coles, Stipendiary Steward presented an Information alleging that Ms D Johnson, the Rider of MELODIUS offended against Rule 638(1)(d) by riding carelessly.  He contended that she permitted her mount to shift out near the 150 metres point when insufficiently clear of the horse DARWON, which was forced onto the horse FLYING OARSMAN on its outside, causing both to be checked.

Mr Williamson illustrated from the race films that Ms Johnson began to move out when DARWON was 1-1¼ lengths behind her mount. DARWON then moved up onto her outside and Ms Johnson continued her outward move so as to crowd DARWON onto horses on its outside leading them to be checked. There was some movement by the horse UNCLE TERRY which contributed in a minor way to the incident.

Submissions for Penalty:

Mr Coles advised that Ms Johnson had a very good record. She has had one suspension for careless riding since January 2020 having had over 600 rides since then.  His view was that the carelessness was "low to mid-range".

Ms Johnson submitted that she was a very busy senior Rider with major riding opportunities in Group 1 and other Black type races over the next two weeks.

Reasons for Penalty:

A starting point of 7 Riding Days is taken.  Ms Johnson's excellent record over very many rides entitles her to a discount of 2 days.
