Decision:

As a result of the committee’s finding the protest was dismissed. The committee ordered that dividends and prize money be paid on the judge’s placings.

Facts:

Mr Bosson alleged that “Secret Agent” placed 2nd by the judge interfered with the chances of “Zaragoza” (3rd) the interference occurring in the home straight.

The official margin between 2nd and 3rd was a long neck.

Judges placings were:

1st Girl Of My Dreams
2nd Secret Agent
3rd Zaragoza
4th Rosada

Mr Oatham identified the horses on all video replays for the benefit of all those present.

Mr Bosson stated that he came from behind Secret Agent, got up to half a length on him, when he then rolled out and took his line of running. He said that Zaragoza is a big two year old who became unbalanced and lost momentum. He added that it took some time for his horse to regain momentum and at the line was taking ground off Secret Agent and that if he had had a clear run he would have finished second.

Mr P McKay reiterated Mr Bosson’s statement and added that the interference had taken everything out of his horse (Zaragoza) and that it cost him a length. He said that they clearly should have been second.

Mr N Harris said that his horse (Secret Agent) did come out for a couple of strides into the running of Zaragoza but that that horse had its opportunity and was not going to beat his horse home.

Mr Tiley said that his horse (Secret Agent) did come out into Zaragoza’s line but that it was minor and that no way in the world was Zaragoza going to beat Secret Agent home.

Mr Neal for the stipendiary stewards said that interference did occur and that Zaragoza gradually made ground to the line, but was it enough to have finished second if interference had not occurred bearing in mind the long-neck margin. He said that that was the decision the committee had to make.

Reasons for Decision:

The committee found that near the 300m Secret Agent did shift out and cause some interference to Zaragoza. However taking into account the degree of interference, where it occurred, the run to the line of both horses subsequent to the interference and the long-neck margin, the committee was not satisfied that if interference had not taken place that Zaragoza would have beaten Secret Agent home.
