Facts:
Information A2705 instigating a protest was filed by Licensed Apprentice Jockey, Mr N Teeluck alleging a breach of Rule 642(1). The information stated that “Gold Allure” or its rider Ms R Myers interfered with the chances of “Brillante Brigitte” ridden by Mr N Teeluck “in the home straight”.
The judge’s placings were:-

The margin between 3rd and 4th was a head.
Rule 642(1) states:-
If a placed horse or its rider causes interference within the meaning of this Rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.
Submissions for Decision:
Stipendiary Steward, Mr Whiterod used the head on film at approximately the 200m point to identify the two horses concerned. This view was replayed several times during the hearing as the parties spoke. Also shown was the side-on and rear view films of the incident.
Mr Teeluck said that near the 150m mark Ms Myers shifted outwards into his running line. He said he had to take a hold of “Brillante Brigitte” and change ground to the inside and then ran on strongly to the line to be beaten by only a head. To a question for the Committee Mr Teeluck said he thought Ms Myers was only half a length in front when she crossed in front of him which caused him to take hold for 2 strides.
Mrs Zimmerman said the film showed there was a gap presented for “Brillante Brigitte” but Ms Myers had moved out and taken Mr Teeluck’s line which required him to have to take a hold and change ground to the inside. She said the margin at the end was very small.
Mr Myers said he believed Mr Teeluck’s horse had been lugging in from the time it rounded the bend into the home straight and when it attempted to take the gap near the 150m point it had shifted in again.
Ms Myers said she agreed with Mr Myers in that Mr Teeluck’s horse had gone for a gap but then ducked inwards as it went to take that gap. She said she didn’t think his horse was going good enough to take the gap and if he had he would have moved up outside her horse which would have meant she “would not have slightly checked him”. She said the check was for only half a stride and didn’t believe that this had cost Mr Teeluck the opportunity to finish ahead of her.
Mr Whiterod said the films clearly showed that near the 150m there was a gap for Mr Teeluck to move into when Ms Myers shifted outwards. He said Ms Myers was approximately one length in front of Mr Teeluck when she moved out causing him to take a brief hold before he was able to finish the race off strongly. He said it was the view of the Stipendiary Stewards that interference had taken place and he would leave it to the Committee to determine if the interference had cost “Brillante Brigitte” a place.
Reasons for Decision:
The Committee has reviewed the head-on and side-on films of the incident several times. The head-on film clearly shows Ms Myers on “Gold Allure” moved out approximately one and half horse widths near the 150m mark and ended up in a position directly in front of Mr Teeluck. The Committee believes Ms Myers was only 1 length clear when she ended up in front of Mr Teeluck and this caused him to momentarily check and steady his horse. He then switched to the inside of Ms Myers and ran on strongly to the line being beaten by a head for third placing. The Committee notes that Ms Myers conceded she had checked Mr Teeluck as a result of her shifting outward albeit, in her view, it being only a “slight check”
The Committee believes the loss of momentum and the need to switch ground to the inside of Ms Myers was such that it cost Mr Teeluck more ground than the margin of the head that he was beaten by in running fourth and that had the interference not occurred he would have finished ahead of Ms Myers.
